1. Acceptance of Terms

Welcome to SGELECTRIK ("we," "our," or "us"). By accessing or using our website, mobile application, and services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use our Platform.

2. Eligibility

You must be at least 18 years old and a resident of Singapore to use our Platform. By using SGELECTRIK, you represent and warrant that you have the legal capacity to enter into this agreement.

3. Account Registration

To access certain features (such as listing vehicles or downloading sales materials), you must register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your login credentials.
  • Notify us immediately of any unauthorised use of your account.
  • Be fully responsible for all activities conducted through your account.

4. Marketplace Listings (Dealers & Distributors)

SGELECTRIK is a discovery and lead-generation platform. We do not sell vehicles directly.

  • Listings: Dealers and Distributors are solely responsible for the accuracy, legality, and completeness of their vehicle listings (including pricing, specifications, and images).
  • Transactions: Any purchase or sale agreement is strictly between the buyer and the dealer/distributor. SGELECTRIK is not a party to any transaction and does not handle title transfers, payments, or vehicle delivery.
  • No Endorsement: We do not endorse or guarantee the condition, safety, or pricing of any vehicle listed on our Platform.

5. Intellectual Property

This clause protects our sales deck, AI systems, and all proprietary work:

  • Ownership: All content, features, and functionality on this Platform, including but not limited to text, graphics, logos, software, AI algorithms, data models, sales presentations, whitepapers, and source code, are the exclusive property of SGELECTRIK and are protected by Singapore copyright, trademark, and trade secret laws.
  • Restrictions: You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of any part of our Platform or sales materials without our prior written consent.
  • Confidentiality: Any sales deck, partner programme presentation, or proprietary data accessed via the Platform is provided on a confidential basis solely for your internal evaluation. You agree not to share, reproduce, or disclose these materials to any third party without our explicit permission.

6. User-Generated Content

By posting reviews, comments, or submitting listings:

  • You grant SGELECTRIK a worldwide, royalty-free licence to display and promote your content on our Platform.
  • You warrant that your content does not infringe the intellectual property or privacy rights of any third party.

7. Prohibited Activities

You agree not to:

  • Scrape, crawl, or harvest data from our Platform without our explicit written permission.
  • Use our Platform to mislead consumers or engage in false advertising.
  • Attempt to circumvent our AI systems or lead-generation algorithms.
  • Post fraudulent, counterfeit, or incorrectly priced vehicles.

8. AI-Generated Insights & Lead Data

Our AI provides predictive insights, range estimations, and lead scoring. These are generated based on available data and are estimates only. You acknowledge that AI predictions are not guarantees of actual vehicle performance, buyer intent, or sales outcomes.

9. Third-Party Links & Government Data

Our Platform may link to third-party websites (e.g., CNA, LTA, or OEMs) for informational purposes.

  • We do not control or endorse these external sites.
  • LTA Disclaimer: Where we utilise data from the Land Transport Authority, Singapore, it is provided for informational purposes only. SGELECTRIK is not endorsed by, affiliated with, or sponsored by the Land Transport Authority. For the most current and official information, please refer directly to the LTA website.

10. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SGELECTRIK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE PLATFORM. TO THE FULLEST EXTENT PERMITTED BY SINGAPORE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SGELECTRIK, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED SGD 100.00.

12. Indemnification

You agree to indemnify and hold SGELECTRIK harmless from any claims, losses, damages, liabilities, and legal fees arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another party (including dealers or buyers).

13. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without prior notice, for violations of these Terms or for any conduct that we deem harmful to SGELECTRIK or its users.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising out of these Terms shall be submitted to the exclusive jurisdiction of the courts of Singapore.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Platform constitutes acceptance of the revised Terms.
